KAJIAN HUKUM TERHADAP PELAKSANAAN DISPENSASI PERKAWINAN DI PENGADILAN AGAMA KELAS I A MEDAN

Abstrak

Marriage dispensation as a legal solution for couples who do not have formal legality to marry, the purpose of this study is to describe and examine and answer problems regarding reasons, legal considerations, and legal consequences in determining marriage dispensations at the Medan Religious Court. Based on the results of research and discussion, it is concluded that one of the reasons for the dispensation of marriage is due to pregnancy outside of marriage, so the impact of this dispensation is as a solution to overcome unrest in society due to pregnancy outside of marriage and to obtain effective legal certainty for women who are pregnant out of wedlock. The application of Article 7 paragraph (2) of the Marriage Law is effective in the life of the perpetrator of the marriage dispensation.
