Abstrak
Abstract: What happens in the household is the joint responsibility of husband and wife, but it is not uncommon for households to experience acts of husband violence against their wives which are commonly referred to as acts of domestic violence. The act of husband violence against his wife is one of the violations of Human Rights (HAM) and constitutes discrimination against women and violates the Law on the Elimination of Domestic Violence. This study aims to determine the criminal provisions for perpetrators of domestic violence based on Law no. 23 of 2004. This research was conducted using a normative juridical approach, in which the author took an inventory of the laws and regulations relating to a particular legal field and measured the level of synchronization (harmony) of laws and regulations relating to a particular legal field. Data analysis used with a qualitative approach can answer and solve as well as thoroughly and thoroughly deepen the object under study in order to produce descriptive conclusions. The results of this study Based on the facts caught in the trial examination, the Public Prosecutor has now arrived at the evidence regarding a criminal act that was singled out for violating Article 44 paragraph (1) of the Republic of Indonesia Law no. 23 of 2004 concerning the Elimination of Domestic Violence. Article 44 paragraph (1) of RI Law no. 23 of 2004 concerning the Elimination of Domestic Violence "Every person is prohibited from abandoning people within the scope of his household, even though according to the law that applies to him or because of an agreement or agreement he is obliged to provide life, care, or maintenance for that person". The conclusion of the research in this trial case is related to Article 44 paragraph (1) of the Republic of Indonesia Law no. 23 of 2004 concerning the Elimination of Domestic Violence "Every person is prohibited from abandoning people within the scope of his household, even though according to the law that applies to him or because of an agreement or agreement he is obliged to provide life, care, or maintenance for that person.
