Analisis Yuridis Terhadap Implementasi Perjanjian Kredit Secara Online
Abstrak
Along with the times and information technology, the economy in the financial sector has also undergone a transformation with the rise of online-based lending. This study aims to discuss and examine technology-based online loan agreements or so-called P2P Lending that are sheltered by fintech companies.The research method used is normative juridical and analytical descriptive. Where in the description the researcher tries to examine the theories and principles of law and legislation relating to every problem and policy in online credit agreements. In the online credit agreement system, the Financial Services Authority (OJK) as the agency that oversees the online loan agreement system refers to OJK Regulation Number 77/POJK.01/2016 concerning Information Technology-Based Lending and Borrowing Services as a legal benchmark for fintech financial services and the regulatory system. Other related laws, need to be studied and understood further in their role based on emerging problems such as customer data and the rise of illegal online loans that ensnare the general public. This study examines various OJK obstacles in monitoring online loans, various OJK efforts in overcoming problems that arise in online loan agreements, and OJK ensures forms of legal protection for parties, both borrowers and online loan service providers. Thus, this research can be useful for finding out what legal rules can underlie online loan agreements for both parties legally, protecting consumer personal data, and accommodating economic developments and relationships between fintech companies and consumers.
