Abstrak

Divorce in Islam is not a ban, but as the last door of the household, when there is no other way out. In fact, legally, divorce has been regulated in Article 38 letter b of Law no. 1 of 1974 concerning Marriage. It explains that the breakup of a marriage can occur due to death, divorce, and court decisions. The incidence of marriage or divorce that occurs in an area is one of the factors that influence the rate of population growth through the birth process, divorce occurs because there is a reason behind it. Currently, divorce cases in Indonesia are still occurring and the number continues to increase. The number of divorce cases has also increased during the Covid-19 pandemic. This research is analytical descriptive in nature, which reveals laws and regulations related to legal theories that are the object of research. Judges' considerations during the Covid-19 pandemic, where during the Covid-19 pandemic there were mostly disputes because the economy was the cause of divorce, the Panel of Judges often used Article 19 letter (f) Government Regulation Number 9 of 1975 jo. Article 116 letter (f) KHI namely between husband and wife there are continuous disputes and quarrels and there is no hope of living in harmony again in the household and several factors causing the increase in the divorce rate are due to economic factors which have experienced a continuous decline so that the husband does not can provide for his wife. The Medan Religious Court has implemented the health protocol as recommended by the government. People who are dealing with court are asked to always wear masks and wash their hands first. Then to prevent the crowd, People who are not interested in having access to the court area are restricted
